Terms of sale
A - Introduction
These general terms and conditions of sale (hereinafter referred to, for brevity, as "sales conditions") govern the sale of products marketed by Antica Fattoria Caseificio Scalabrini di Ugo & Bruno. s.s. (hereinafter referred to as "seller" for brevity) with the website old.fattoriascalabrini.it . .
All purchase contracts concluded between the seller and the customer, through the website. old.fattoriascalabrini.it According to the procedures indicated there, they will be governed by the present sales conditions.
All published prices are inclusive of VAT.
B - Acceptance of sales conditions
1. The sales conditions have been prepared in full compliance with the fundamental principles set out by Directive 97/7/EC and Legislative Decree no. 206/05 (articles 50 to 68) for the protection of consumers in distance contracts.
These sales conditions are effective from the date of acceptance by the Customer on the website, which is considered as acceptance in accordance with Article 1341 of the Civil Code. The seller reserves the right to modify these sales conditions at any time by posting them on the website. Any contractual or extra-contractual liability on the part of the seller for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order is excluded.
2. By placing an order through the various available methods, the Customer declares to have read all the instructions provided during the purchasing process and fully accepts the sales and payment conditions transcribed below.
3. If the Customer is an end consumer (meaning an individual who purchases goods for purposes not related to their professional activity), once the online purchase procedure is completed, they will proceed to print and/or save an electronic copy and, in any case, keep these sales conditions, in compliance with articles 50/60 of Legislative Decree 206/2005 on distance selling.
4. Any right of the Client to compensation and/or indemnity is excluded, as well as any contractual and non-contractual liability, for direct and/or indirect damages to persons and property caused by the non-acceptance, even partial, of an order.
C - Purchasing methods
1. The customer can only purchase products that are available in the seller's electronic catalog and as described in their respective information sheets.
Please note that the images accompanying the product description sheet may not be perfectly representative of its features and may differ in color, size, products, and accessories shown. All purchasing support information is intended as simple informational material and should not be referred to as the real characteristics of each individual product.
2. The correct receipt of the order is confirmed by the seller through a response via email, sent to the email address provided by the Customer.
The confirmation message displays all the data entered by the Customer, who commits to verifying their accuracy and promptly communicating any corrections, following the methods described in this document.
3. In case of non-acceptance of the order, the seller undertakes to promptly communicate this to the customer.
4. All prices on the website are to be intended as retail prices and, therefore, inclusive of VAT.
The seller reserves the right to change prices at any time, without prior notice.
5. On the website old.fattoriascalabrini.it The availability of the product is visible at the time of ordering. Since the simultaneous access of many users-customers and the simultaneous possibility of "on-line" orders can modify the product availability, the seller therefore does not guarantee the certainty of allocation of the ordered goods.
6. For certain products subject to promotions/offers, the seller reserves the right to accept orders by reducing the quantities, upon prior communication and acceptance by the Customer, failing which the order must be considered canceled.
D - Payment methods
1. Advance bank transfer
In case of payment by advanced bank transfer, the shipment of the ordered items will only be made upon the actual credit to the seller's bank account, which must occur within 3 working days from the date of order acceptance. After this period, the order is automatically considered canceled.
The reason for the advance bank transfer must include the identifier of the order (order number and date), which is provided in the order confirmation email.

2. Credit card
The accepted credit cards are all those that are supported by the service offered by PayPal.
In cases of purchasing goods with a credit card payment method, at the same time as the conclusion of the online transaction, the relevant Bank Institution charges the amount related to the purchase made.
In case of order cancellation, either by the Customer or in the event of non-acceptance by the seller, the same will promptly request the cancellation of the transaction and the refund of the amount.
The cancellation of the order is possible until the moment it is not yet being prepared.
The refund times, for some types of credit cards, depend solely on the banking system. In the event of a transaction cancellation, the seller cannot be held responsible for any damages, direct or indirect, caused by delays in the non-accreditation of the amount by the banking system.
The seller reserves the right to request additional information from the customer (such as a landline phone number) and/or the submission of copies of documents proving ownership of the credit card used.
In the absence of the required documentation, the seller reserves the right not to accept the order.
At no point during the purchase process, the seller is able to know the credit card information of the buyer, as they are entered directly on the PayPal site that manages the transaction (with highly secure systems); since there is no data transmission, there is no possibility that this data will be intercepted.
No computer archive of the seller contains or retains such data. In no case can the seller be held responsible for any fraudulent and/or unauthorized use of credit cards by third parties, at the time of payment for products purchased on the website. old.fattoriascalabrini.it . .

G - Right of withdrawal
The right of withdrawal is the Customer's right to withdraw, for any reason and without penalty, from a distance purchase contract (subject to the exceptions indicated below).
The right of withdrawal consists of the refund of the total amount paid by the Customer upon the return of the purchased goods and is legally applicable to distance purchases made by consumers "for purposes not related to any professional activity that may be carried out", excluding purchases made by retailers and corporate customers in general.
The right of withdrawal is regulated by Legislative Decree no. 206/05 (articles 50 to 68).
The right of withdrawal is subject to the following conditions:
* it applies to the product purchased in its entirety, it is not possible to exercise the right of withdrawal on only part of the purchased product;
* does not apply to products once opened;
* The purchased goods must be intact and returned in the original packaging, complete in all its parts; to prevent damage to the original packaging, it is recommended, when possible, to place it in a second box.
* in accordance with the law (article 67), the shipping costs related to the return of the item to the seller are the responsibility of the customer;
* the shipment, up to the proof of receipt in the seller's warehouse, is under the complete responsibility of the Customer;
* In case of damage to the goods during transport, the seller will inform the Customer of the incident (within 5 working days from the receipt of the goods at the seller's warehouses), to allow the Customer to promptly file a complaint against the chosen courier and obtain a refund of the value of the goods (if insured); in this eventuality, the product will be made available to the Customer for its return, simultaneously canceling the withdrawal request.
* the seller does not assume any responsibility for damages or theft/loss of goods returned through uninsured shipments.
* Upon arrival at the warehouse, the product will be inspected to evaluate any damage or tampering not resulting from transportation.
1. Procedure for exercising the right of withdrawal
To exercise this right, the Customer must submit a withdrawal request to the seller, in which it will also be necessary to indicate the necessary bank details for any refund of the amounts paid; the seller will send the Customer a paper form via email, which must be printed and sent by registered mail with return receipt requested within 10 working days from the date of receipt of the goods to:

Upon receiving the registered letter, the seller will send the Customer the withdrawal form by email, which will include an authorization number that must be attached to the outside of the package in which the product will be physically placed. The package must then be sent to the seller within 10 working days from the authorization.
The seller will refund the entire amount already paid to the Customer as soon as possible and in any case within 30 days from the date of receipt of the withdrawal communication, upon receipt of the goods subject to withdrawal, through the reversal procedure of the amount charged to the credit card or by bank transfer.
In this case, it will be the Customer's responsibility to promptly provide the bank details for the refund, including the invoice holder's name and the IBAN and SWIFT codes.
The right of withdrawal lapses completely due to the lack of the essential condition of integrity of the good (packaging and/or its content) in cases where the seller also verifies one of the following conditions:
* the absence of the outer packaging and/or the original inner packaging;
* the absence of integral elements of the product and/or anomalies in the product itself;
* damage to the product due to causes other than its transportation;
* a state of product dirtiness that has compromised its integrity;
* the opening of the product.
The costs and risks of transportation for the return are entirely borne by the Customer, who may arrange the shipment of the product only and exclusively through a courier.
The return of products that are not intact, damaged, and/or lacking accessories and/or original equipment will not be accepted by the seller, and the merchandise will be returned to the sender with additional shipping costs and any other possible additional expenses.

L - Jurisdiction and Applicable Law
The sales contract between the Customer and the seller is considered concluded in Italy and governed by Italian law. For the resolution of civil and/or criminal disputes arising from the conclusion of this sales contract, the territorial jurisdiction is exclusively that of the Court of Reggio Emilia (RE).
M - Conditions
